Accepting the Terms of Service Sorcerer's Place agrees to furnish services to the hosted site owner(s) ("HSO"), subject to the following Terms of Service. By accepting hosting on Sorcerer's Place, HSO agrees to be bound by these terms and conditions, and any changes made to them at any subsequent time. The Service Hosting on Sorcerer's Place is provided as-is, without guarantee for function for any particular use, usability, or availability. HSO agrees that Sorcerer's Place may add or change service limitations at any time, with or without notice. Suitable Content The content of a website is defined as any publicly viewable or downloadable pages and files, and must be in English. HSO is responsible for any content transmitted to the Sorcerer's Place server. It is the responsibility of the HSO to make sure that the content posted on their site complies with Sorcerer's Place rules and these Terms of Service. Sorcerer's Place does not guarantee the accuracy, legitimacy, quality or integrity of any content. Sorcerer's Place does not guarantee that content will be protected from any loss, deletion, removal or damage. Backups are currently not guaranteed, so they are the sole responsibility of the HSO. Prohibited Content HSO may not post, upload, link to or e-mail any content that contains, promotes, gives instruction about, or provides prohibited content. HSO is responsible for any content that violates any local, state, county, national or international law or treaty. Prohibited content also includes content that infringes upon any rights, including, but not limited to, copyrights and trademarks, abusive, threatening, defamatory, racist, or obscene content, viruses or any other harmful computer software, spam, chain letters, or pyramid schemes, gambling or illicit drugs, terrorism, hacking or cheating for Internet or online games, warez, roms, CD-keys, cracks, passwords or serial numbers, pornography, invasion of privacy or impersonation of any person or entity. Content Screening Sorcerer's Place does not preview any content transmitted but reserves the right to check any hosted site for prohibited content. Sorcerer's Place has the right to access any hosted site and its related content and delete, edit, or restrict access to any content, with notice to the HSO. HSO agrees that Sorcerer's Place may disclose any content required by law or is necessary to comply with legal processes or to prove a violation of these Terms of Service. Sorcerer's Place is not responsible for any problems that may occur from reading, distributing, acting on, or using content posted by our hosted sites. Advertising Content Hosted sites may not place any additional forms of advertising on their pages, unless granted an exception by Sorcerer's Place. Network Performance Hosted sites operate on shared resources. Excessive use or abuse of shared network resources by one hosted site may have a negative impact on all other hosted sites. Misuse of network resources in a manner which impairs network performance is prohibited by these Terms of Service and may result in temporary suspension of a hosted site. Hosted sites are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. Hosted sites may not use resource-intensive programs which negatively impact other hosted sites or the performances of Sorcerer's Place systems or networks. Sorcerer's Place reserves the right to terminate or limit such activities with or without notice. Disclaimer of Warranties HSO agrees and understands that use of services provided by Sorcerer's Place is at their own risk. HSO understands and agrees that Sorcerer's Place will not be liable for any damages, direct or indirect, resulting from use and/or inability to use the service. Modification of these Terms Sorcerer's Place reserves the right to revise, amend, or modify these terms at any time and in any manner. All changes are effective at the time of posting. Hosted site's continued use of the service will constitute acceptance of any modifications made. Sorcerer's Place gives no warranty, expressed or implied, for the services provided, including, without limitation, warranty of merchantability and warranty of fitness for a particular use. HSO hereby agrees to indemnify and hold Sorcerer's Place and its subsidiaries, affiliates, volunteers, agents and employees harmless from any demand made by anyone due to the content posted to the hosted site, hosted site's use of this service, or hosted site's violation of any law or these Terms of Service.
