When i'm attacking with Foebane than my magic resistance is preventing me from gaining life.
Is this a bug or should it be so ?

It's a bug. Baldurdash has a fix:

Foebane Larloch's Minor Drain Magic Resistance Failure Fix prevents the wielder's Magic Resistance from interfering with the four bonus Hit Points that Larloch's takes from the target and applies to the wielder on a successful hit. The Magic Resistance of the target, of course, is still checked.
